Finally, note that the Draft Permit includes updates to DEP’s Model Stormwater Ordinance that, at the time of this writing, must be incorporated by municipalities by 2028. Permittees should consult with their staff and consultants about necessary revisions to their stormwater management ordinance to comply prior to that deadline. At the time of this writing, we do not know when DEP will issue a final permit, but we anticipate that few changes will be made to the Draft Permit or draft ordinance. Therefore, permittees should start planning now for compliance with the new volume-based regulatory scheme. Here are a few steps you can take now: • Review the Draft Permit and model ordinance with your staff and consultants. • Work with your staff and consultants to identify what impervious areas in your municipality are currently controlled by BMPs and what areas will need to be mitigated in your VMP. • Identify potential VMP partners.
